Tax Proration

Definitions

Advance:  Taxes are paid before the time frame for which taxes are billed.

Arrears:  Taxes are paid after the time frame for which taxes are billed.

Calendar Year:  January 1 through December 1

Fiscal Year:  The year begins with the Tax Date

Primary Residence Exemption or Homestead Exemption:  The rate at which the millage is discounted on an owners’ primary residence. They must claim the address as their primary residence and can only claim one address.

Millage (mils):  The amount levied by the county or municipality

Proration:  The amount of taxes owed by a buyer or seller for the time during the year they own the house.

Property Taxes:  Taxes owed per homeowner are based on the rate and millage per municipality, county, and state.

Tax Proration:  Tax proration is negotiated during the offer stage of a transaction. The agreed-upon Purchase Agreement will determine if taxes are to be prorated by calendar year, fiscal year, or no proration.

It is necessary to know how taxes are billed in the county and municipality in which the home is located. Are the taxes paid in advance or in arrears? When are the tax bills due and payable? In Muskegon County, the Summer Tax bill comes out July 1, and the Winter Tax bill comes out December 1, with taxes paid in advance. The Summer tax bill that comes out on July 1 and is due before September 15 pays for July 1 in that year through June 30 of the following year. The Winter tax bill that comes out on December 1 and is due by February 15 of the following year pays for taxes from December 1 of that year through November 30 of the following year.

Calendar Year: Taxes that are to be prorated based on the calendar year utilize the tax bills for the year the transaction closes. Taxes are prorated to the date of closing, with the seller paying from January 1 through the day before closing, and the buyer paying for the day of closing forward.

Fiscal Year:  Taxes prorated based on the fiscal year utilize the tax bills that include the day transaction closes. Taxes are prorated to the date of closing, with the seller paying a combination of taxes from July 1 through the day before closing plus December 1 through the day before closing, and the buyer paying for the day of closing to the end of both summer and winter fiscal tax years (June 30 and Nov.30).

No Proration:  Taxes with no proration means that the seller pays for the tax bill(s) that come out before the day of close, and the buyer pays the tax bill(s) that come out the day of close or after.
